Rules and Regulations
(Applicable from 01-04-2021)
ARTICLE 1
Title
(i) The Organisation shall be called the “Ice Skating Association of India” (here-in-after called the “ISAI”).
(ii) I.S.A.I. will have its head quarters at Delhi which is its place of its registration.
ARTICLE 2
Area of activities
The territorial area of the ISAI for its activities shall extend to the whole of the Republic of India.
ARTICLE 3
Sports
The activities of the ISAI amongst others will cover all kinds of Ice Skating sports: Ice Skating and any other Ice Skating sport subsequently introduced by ISU.
ARTICLE 4
Definitions
(a) A ‘Unit’ means any affiliated member of ISAI, with voting rights.
A club means any member of ISAI without voting rights.
‘Organisation’ means any organisation of All-India standing.
‘Association’ means Winter Games Association or Ice Skating Association.
ISU means International Skating Union.
ASU means Asian Skating Union.
Year shall be from 01 April to 31 March of the following year.
S.A.I. means Sports Authority of India.
M.Y.A.S. means Ministry of Youth Affairs and Sports, Government of India. Government means M.Y.A.S. unless mentioned otherwise.
ARTICLE 5
Membership
Membership of the Association shall be open to:
(i) An Ice Skating Association in a State and Union Territory subject to the restrictions that from each State and Union Territory only one such association shall be admitted to the membership with voting rights.
(ii) Winter Games Association in States and Union Territories subject to the restrictions that from each State and Union Territory only one such association shall be admitted to the membership with or without voting rights.
(iii) Any Winter Sports Association or Ski Association in a State or Union Territory will be considered as Winter Games Association of that State or Union Territory if it deals in Ice Skating sport.
(iv) Any organisation of All-India standing may be given the status of a State or that of a Union Territory, without voting rights as may be decided by the General Assembly from time to time.
(v) The geographical boundaries of a State/Union Territory shall be the same as recognised by the Constitution of India.
(vi) Honorary Members. The General Assembly may elect persons of National/International distinction as Honorary members without voting rights.
(vii) There is no restriction on units from one state or union territory in giving membership without voting rights.
(viii) Simla Ice Skating Club, Shimla will be considered an All India organization due to its historical and heritage value.
(ix) Only one Association from each State/Union Territory shall be admitted as a member of the I.S.A.I. with voting right. The I.S.A.I should take into consideration the representative character of the State/Union Territory Associations so as to ensure that only truly representative body of the game gets the recognition/affiliation.
(x) Preference will be given to the Association which will be affiliated to its State/U.T. Olympic Association.
ARTICLE 6
Affiliation/Recognition
(i) Any organization/institution desirous of affiliation/recognition with ISAI, would apply on the prescribed form or on its letter head.
(ii) Any Association that wants to be a member, will apply for the membership with proper certificate of registration with Registrar of Societies [or any proof of respective state Govt. that it is recognized by the state Govt.], list of its Office Bearers, List of Members, Memorandum & Rules and Regulations.
(iii) The application shall be placed before the General Assembly only through the Executive Council for its consideration.
(iv) The General Assembly shall have the right to accept or refuse membership to any organisation or category at its absolute discretion assigning no reason thereof.
(v) The rules shall be fully binding on its units.
(vi) Members with voting rights will be called Affiliated Members.
(vii) Members without voting rights will be called Recognised Club Members.
(viii) All types of membership will be given, initially for two years, without voting rights. After seeing performance, voting rights may be given by General Assembly only after two years.
ARTICLE 7
Affiliation Fees
(a) Rs. 20,000 will be admission fee and Rs. 2000 will be annual affiliation fee for all units and clubs. Fee may be changed by the General Assembly from time to time. Honorary members and Founder Members will not pay any kind of fee.
ARTICLE 8
Payment of Subscription
(a) The annual subscription fees payable to the ISAI shall fall due on 1st day of April every year, irrespective of the date of their addmission/affiliation/recognition. If any unit or club does not pay the dues within the stipulated period of 90 days i.e. upto 30 June of the year, it may be expelled by the General Body or Executive Committee after giving a notice by the Secretary/Treasurer to deposit fee within 15 days of notice.
(b) Membership of the defaulting unit or club may be restored subject to approval of the General Body/Executive Committee if subscription is received within one year along with admission fee applicable at that time for new members.
ARTICLE 9
Disaffiliation for Other Reasons
(a) If the General Assembly feels that any unit is not working properly, an opportunity shall be given to it to explain its conduct in this regard and the General Assembly shall have full authority to take such action as it deems fit to improve its working or for its suspension or termination of its membership.
(i) A member with voting right must send a team in at least one competition recognised by ISAI in a year. If it does not send the team for two consecutive years, its voting right will be automatically suspended from 1 st April of next year.
(ii) However, if it participates in any competition recognised by ISAI in any year in the next 5 years, its voting rights will be automatically restored from 1 st April of next year immediately after the year of participation.
ARTICLE 10
Voting Rights
(a) (i) All units affiliated to ISAI with voting rights shall have the right to vote at every General Assembly Meeting of the ISAI and shall have two votes. Permission to vote is subject to condition that all the dues of the ISAI have been paid and belongings of the ISAI are restored to the ISAI.
(ii) No, other class of members of the ISAI shall have any right to vote. From one state or Union Territory, there will be only 2 votes.
(b) Formulae of one state (or U.T.) one unit with voting right will only be applicable.
(c) Only states and U.T. associations will have voting rights.
ARTICLE 11
General Assembly
There shall be a General Assembly of the ISAI composed of the following:
(i) President 1
(ii) Secretary General 1
(iii) Vice Presidents 3
(iv) Hony Treasurer 1
(v) Joint Secretaries 3
(vi) All members (with voting right)
(vii) Honorary Members By Invitation
(viii) Founder Members All founder members alive at the time of meeting of the General Assembly (without voting right).
(a) No unit shall have representative in General Assembly including office bearers more than the number of its votes for any reason whatsoever.
(b) At the time of election only the persons sent by the unit will cast vote and not the above officials if the person is different.
(c) Only members with voting rights, special invitees, founder members, honorary members, four members of Athlete Advisory Council and chairmen of different committees will be part of General Assembly.
(d) President to assist himself, can appoint any person as Office Secretary with or without salary subject to the amount of salary approved by the General Assembly. Office Secretary will not have voting right and he will act on instructions of President or Secretary only.
(e) The General Assembly shall be the controlling body of the Association. All authority shall vest in it and decision of the Assembly shall be binding on all members. The General Assembly shall have the authority to delegate and vest its own authority to any Committee, Sub-Committee as may be considered necessary and define and determine their powers, duties, scope and terms of references unless otherwise provided for.
(f) The General Assembly shall frame necessary rules and regulations and fill up vacancies in the General Assembly/Executive Council during the session.
(g) The quorum for Annual General Assembly Meeting, Special General Body Meeting, shall be one-third of the representatives entitled to vote.
(h) President or the Secretary on behalf of President shall give 15 days notice for any meeting including election meeting.
ARTICLE 12
Meetings
A. (i) All meetings will be called by the President or by the Secretary General on behalf of President according to the decision of the General Assembly or the Executive Council or as may be considered necessary by the President.
(ii) Special General Body meetings may be called if and when necessary by the Executive Council or by the Secretary General under the orders of the President or by the President himself.
(iii) A requisitioned meeting of the General Assembly may be called by the Secretary General or by the President on the written requisition signed by not less than one-third affiliated members of the ISAI with voting rights. If the Secretary or President fails to convene the meeting within 30 days from the date of receipt of the requisition, the requisitionists may convene the meeting giving a clear 15 days notice with agenda, time and place. A requisition meeting will not be considered valid if the outlined rules are not strictly complied with. Decision at such a meeting will be valid only if they are passed by 2/3rd of the members present at that meeting.
Quoram of this meeting should be 2/3rd of the total members having voting right.
B. The Annual General Assembly Meeting of the ISAI shall be held every year. The following business will be transacted at the Annual General Assembly Meeting:
(i) Confirmation of the Minutes of the last General Meeting.
(ii) To adopt Secretary’s Report.
(iii) To consider and pass the Audited Statement of Accounts
(iv) Ratification of the Membership granted/ suspended/terminated, if any, by the Executive Council.
(v) To consider amendments, if any, for which due notice has been given.
(vi) To appoint auditors for the ensuing year and fixing their remuneration.
(vii) To prescribe and fix fees for all matters and purposes, if necessary.
(viii) To discuss agenda points.
(ix) To constitute International Competition Committee tenure of which will be till next AGM.
(x) To conduct elections if due.
(xi) Any other business with the permission of the Chair.
(xii) If any four or more persons with voting rights write to the Secretary General resident 7 days before any meeting to include any point/s in the agenda, that point/s will be the agenda points and will be taken up for discussions after finishing the circulated agenda points.
(xiii) Voting, if necessary, in any meeting of ISAI shall be by show of hands unless objected by any member. Elections of the Office-bearers & Executive Council Members of the ISAI shall always be by secret ballot.
(xiv) Any meeting of General Assembly, once called, cannot be cancelled unless signed by both, the President and the Secretary General.
ARTICLE 13
Powers, Duties and Functions of Executive Council
(a) There shall be an Executive Council of the ISAI which shall comprise of the following:
(i) President
(ii) Secretary General
(iii) All the Vice Presidents
(iv) Hony. Treasurer
(v) All the Joint Secretaries
(vi) Five members elected from the General Assembly, at least one woman.
No unit shall have representatives in the Executive Council including office bearers more than the number of its votes for any reason whatsoever.
(b) If any member of Executive Council does not remain office bearer but remains member of his/her unit, still he/she will be office bearer of ISAI or member of Executive Council with voting right.
(c) If any office bearer of ISAI or member of Executive Council retires from his/her unit or does not remain member of his/her unit, he ceases to be office bearer of ISAI or member of Executive Council and same will be elected by General Assembly in the next meeting.
(d) The Executive Council shall have the powers to fill up any vacancy for any post in the Executive Council.
(e) The Executives Council is to endorse the policies, decisions, resolutions and directives of the General Assembly and their Committees and Sub-Committees. In addition Executive Council is to conduct and administer the day to day work of the Association and to form standing Sub-Committees and such other Sub-Committees as may be considered necessary.
(f) Executive Council shall meet at least twice a year. The notice for the normal meetings shall be 15 days and emergency meetings 7 days. There should not be gap of more than 8 months between two consecutive meetings.
Qorum for this will be one third of the total numbers of members of the executive committee.
(h) If quorum is not complete, adjourned meeting after a gap of 30 minutes shall be called and for that no quorum is necessary. The decisions taken in such meeting will be confirmed in next meeting and will be applicable till next meeting only.
(i) The Executive Council is to exercise the authority of the ISAI, in discharging the functions of the General Assembly according to the rules and regulations.
(j) All units and office bearers shall be bound to carry out orders and decisions of the Executive Council and the General Assembly and its office bearers authorised for the purpose.
(k) The Council shall co-ordinate, assist and guide activities and functioning of the units and clubs. The Executive Council shall collect, receive and acquire grants, funds, donations, contributions trophies, shields, awards and other properties, movable or immovable on behalf of the Association.
(l) The Executive Council shall also deal with participation of National teams in International tournaments and invitation to team/participants from abroad.
(m) Executive Council shall exercise all financial powers on behalf of the General Assembly.
(n) If a Member or an office bearer absents from three consecutive meetings of the Executive Council without leave of absence of the Executive Council, the Member would be deemed as removed from the office. This provision, however, does not apply in the case of a Member who absents for the three stipulated/consecutive Executive Council meetings in case the Member is deputed to attend on behalf of the ISAI other meetings/functions connected with the ISAI.
(o) Each representative, except invitees shall be entitled to one vote.
ARTICLE 14
International Competition Committee
(i) An International Competition Committee shall be formed by the General Assembly which shall be consisting of President, Secretary General and at least one other member. Name of this member shall be decided by General Assembly among its members with voting rights present in the Assembly.
(ii) Tenure of this Committee will be till next A.G.M. However, due to any reason if General Assembly does not form the International Competition Committee in any A.G.M., the previous committee will continue.
(iii) This committee will decide the names of coach/es, official/s, going abroad with the team for each event.
(iv) All the members of this committee can discuss and decide on phone. If there is no consent, members can exchange by e-mail.
(v) President or Secretary will invite names of coaches and officials from all the members of this committee, by phone, fax, letter or e-mail. If no reply is received within 5 days, it will be taken as absentee.
(vi) In case of tie, President will have casting vote in addition to his own vote.
(vii) Officials going abroad
If any office bearer including President goes abroad, for any event, representating I.S.A.I., he will be paid by the I.S.AI., maximum half of the expenses occurred. Expenses should be done in economical way.
ARTICLE 15
Financial Year and Audit
(i) The financial year of the ISAI shall be from 01 April to 31st March of the following year.
(ii) The accounts shall be maintained properly. The Association, shall appoint a practicing Chartered Accountant to audit their accounts. The records and accounts of the Association will be accessible to the Government and these shall have to be produced as and when asked to do so. If the grant-in-aid from the Government to the I.S.A.I exceeds one crore rupees in any year the annual accounts for that year shall be further subjected to audit by the Comptroller and Auditor General. If M.Y.A.S. issue any other guidelines in this regard, same will be followed.
(iii) The statement of the audited accounts shall be submitted to Income Tax Department within six months of the closing of the financial year.
(iv) All vouchers of the expenses should be signed by any two of: the President, Secretary and Treasurer. However they can authorize in writing to any other person on their behalf to pass and sign vouchers of expenses.
ARTICLE 16
Operation of Bank Account
Account shall be maintained in the name of the Ice Skating Association of India in such scheduled and/or Nationalised Bank or Banks as may be approved by the General Assembly and shall be jointly operated by any two of the following officer-bearers:
(a) President
(b) Secretary General
(c) Hony. Treasurer
with signatures of any two out of above three.
ARTICLE 17
A. President
(i) The President shall preside over all meetings of the General Assembly and Executive Council. In his absence one of the Vice Presidents present in the meeting will be the Chairman. If the President, and any of Vice Presidents are not available, the General Assembly or the Executive Council as the case may be shall elect its own Chairman from amongst the members present.
(ii) The President shall have the authority to suspend summarily any member and/or official/office bearer excepting Secretary General and Hony. Treasurer of the ISAI in serious cases of misconduct or disobedience. His action, however, will be confirmed by the Executive Committee within 2 months and also will be confirmed by the General Assembly within 6 months, otherwise suspended member will not be deemed to be suspended.
(iii) Special General Body meetings may be summoned by the President at his discretion.
The President shall have a casting vote in case of a tie in addition to his own, except at the time of election of the President.
(iv) The President, with the consent of the Secretary General, shall have the authority to form ‘adhoc’ Committee/other Committees as and when necessary for the smooth functioning of the ISAI. The General Assembly or Executive Council will, however, be kept informed of all such measures which shall be approved by it within 120 days.
(v) President, with the consent of Secretary General, will have the authority to appoint Chairmen of Committees or Sub-Committees. These Chairmen may not be members of General Assembly; however in case they are not member of General Assembly, they will not have the Voting Rights. The General Assembly or Executive Council will, however, be kept informed of all such measures which shall be approved by it within 120 days.
(vi) To approve the Annual Report, if necessary.
(vii) At any meeting, the President shall have the right to interpret the rules and decide the order of precedence of all points raised by the Members. However, the decision of the General Assembly shall be final.
(viii) The President, with the consent of Secretary, shall have the authority to nominate any co-opted members either in the General Assembly or in the Executive Council meetings. Such members will have no voting right.
B. Secretary General
The Secretary General shall be in-charge of the day-to-day administration of the Association and shall transact all official business in accordance with the decisions of the President, General Assembly and Executive Council. He shall be responsible for calling any meetings of the ISAI as per rules and to implement the decisions taken in the meetings. He shall be responsible for carrying on all correspondence in the name of the Association unless otherwise directed by the President for a particular topic. He shall keep and maintain the minutes of all meetings of the ISAI General Assembly and Executive Council of the Association, the register of Members and all such records as may be necessary for the smooth and efficient working of the Association. He shall prepare and submit at the Annual General meeting of the Association his Annual Report. He shall convene meetings of the Association.
C. Joint Secretaries
They shall perform such duties as may be assigned to them from time to time by the President or/and Honorary Secretary.
D. Patron
President may nominate persons of national repute as patrons. However these persons will not have any voting right.
E. Vice Presidents
(i) They shall perform such duties as may be assigned to them from time to time by the President.
(ii) In absence of President, one of the Vice Presidents, deputed by the President, will act as President.
F. Treasurer
(i) He shall operate day to day expenses of I.S.A.I.
(ii) He can keep with him as cash balance maximum upto Rs. 50,000 for day to day expenses.
(iii) He shall keep record of all accounts and maintain account books.
ARTICLE 18
Amendment to Rules and Regulations
(a) (i) Amendment to the Rules and Regulations shall be made at the Special General meeting by two-third votes of members present. The quorum for such meeting will be 2/3 of the total strength of the representatives of the ISAI entitled to vote.
(ii) The Special Resolution shall be circulated by the Secretary or by the President to each affiliated unit along with the notice of the Special General Assembly meeting. But this proposal should be passed by the Executive Council by majority votes.
(b) Changed rules will be sent to Registrar of Societies for information.
ARTICLE 19
Elections
A. Elections shall be held within four years, at the Annual General Meeting to elect the office bearers and Executive Council members.
If Annual General Body Meeting is not called, elections can be held in a requisitioned meeting if tenure is over.
(i) All units will forward to the ISAI ‘nominations’ of their candidates entitled to vote 10 days prior to the holding of the elections in the meeting of the ISAI. The recommendation of nominations’ will indicate the name of the candidate and the position held by him in the unit. Change of name of the nominated candidate will not be allowed unless prior permission in writing is obtained from both the President and the Secretary General of ISAI.
(ii) If no names are received by Secretary General or President ten days prior to the holding of elections, only President and Secretary can cast the vote at the time of the election.
(iii) The right of exercising the vote shall vest in accredited representatives deputed by the units. A representative accredited by the unit must be a member of that unit at least for one year and would attend the ISAI meeting in which elections are to be held, on production of a certificate signed by both the President/Head and the Secretary of the unit concerned detailing him for attendance on his behalf.
(iv) In case, there are two separate certificates respectively from the President/head and the Secretary of the unit, one person from each certificate will be allowed to attend the meeting.
(v) However, when a representative of the unit attends ISAI meeting in which elections are not to be held, the Accreditation Certificate may be signed by the President or Secretary of the unit concerned detailing him for attendance on their behalf. If a representative from the unit produces a Certificate signed by the President and another representative from the same Organization produces a Certificate signed by the Secretary, then the Certificate signed by the President/Head will be accepted.
(vi) One and the same person shall, under no circumstances, be entitled to represent more than one unit.
(vii) No office-bearer of a unit shall be eligible to be office-bearer simultaneously of any other unit excepting the ISAI, otherwise those units will not have voting rights.
(viii) The General Assembly shall elect its office bearers and members of the Executive Council only from amongst the members, having voting rights.
(ix) Any vacancy which occurs in the Executive Council shall be filled from the remaining office-bearers and Members of the Executive Council and Members of the General Assembly, maybe nominated by the President. This shall be regularised during the very next meeting of the General Assembly.
(x) A Returning Officer will be appointed by the Executive Council with the agenda of Election of Executive council at least 20 days prior to the date of election.
(xi) The Returning Officer should be either a sitting or retired judge, senior Advocate or any retired army officer not retired from the post of less than a brigadier or any person of national repute associated with Winter Sports and should not be a candidate for any post of Executive Council of ISAI.
(xii) Any person or his/her immediate family members, living in same house, having commercial interest in his/her individual capacity in skating or in any activity mentioned in Article 3, he/she cannot become office bearer of the ISAI.
(xiii) Any person or his/her immediate family members, living in same house, working in or working for any private commercial organization which has skating and /or any activity (or activities) mentioned in Article 3 as its business can not become office bearer of the ISAI.
(xiv) Election for the post of President will be conducted first. If President is not elected due to tie, election will be held again within one hour among the persons who have tie votes. If still it is tie, President will be elected by draw of chits, procedure of that will be decided by the returning officer.
(xv) In case of tie in the election of other office bearers and Executive Council members, President elected above, will have tie vote in addition to his own vote.
(xvi) Candidates for the post of President and Secretary should be member of Executive Council of ISAI at least for 3 months.
(xvii) Any voting member working in any Govt. body (centre, state, U.T., local bodies, Govt. Undertaking) wants to file his/her nomination for any post of ISAI, he/she should take prior permission from his department, and should submit the same to the returning officer, otherwise his/her nomination will be considered cancelled.
(xviii) After recognition by the Ministry of Youth Affairs and Sports, Govt. of India, all the rules of the model code of elections prescribed in National Sports Legislation of M.Y.A.S., which may be amended from time to time will be applicable and not these rules, if any rule is different.
(xix) Provided in case of any dispute regarding the aforesaid election procedure, such dispute shall be referred to the ‘Sports Dispute Settlement or Appellate Tribunal’ of M.Y.A.S., whose decision shall be final.
B. The eligibility of a candidate to contest for elections for I.S.A.I shall include the following:
(i) shall be a citizen of India
(ii) shall not be less than 25 year of age.
(iii) shall not have been convicted in any criminal case
(iv) have not been declared insolvent;
(v) shall represent any State of India having voting right, which is a unit of I.S.A.I.
(vi) shall cease to hold the office of an office bearer or member on the Executive Body on attaining the age of seventy years.
(vii) Union Minister in the central government, or any minister in a state/U.T charged with the responsibility of sports or any officer of SAI or any officer of department of M.Y.A.S. shall not be eligible to contest for any elected post in the I.S.A.I. until the expiry of five years from the date of relinquishing the charge.
(viii) After recognition with M.Y.A.S., or/and Indian Olympic Association, No Office Bearer of the I.S.A.I. shall be eligible to concurrently hold the post of an office bearer in any other National Sports Association, excepting the National Olympic Committee.
(ix) he/she shall not of age greater than the age specified by the National Olympic Committee or the I.S.A.I. at the time of contesting the election and should not be more than seventy years during the elected tenure.
(x) Article 19 B (vi), 19 B (ix) and 20(ii), 20(iii) will be applicable only after getting recognisation from Ministry of Sports and Youth Affiairs.
ARTICLE 20
Tenure of Office-Bearers
(i) Any member can not remain office bearer except President for more than 8 years with or without break.
Provided that an Office Bearer, who has held the office as such for two consecutive terms, (each term not exceeding four years), shall be eligible to hold such office after cooling off period of four years from the date on which he vacated the second term:
Provided further that this clause shall not apply to any election for the office of President, for which there is no cooling off period;
(ii) President shall not be eligible to re-contest for the post of President on completion of twelve years or three terms of office with or without any break. Any member can not remain President for more than 3 terms i.e. more than 12 years, with or without break.
(iii) If due to any reason new Executive Council is not elected before the expiry of tenure of existing Executive Council, all powers will be vested with the existing Executive Council and not with any office bearer. However Executive Council must call a General Assembly meeting within 3 months of the expiry of tenure beyond which if office bearers are not elected, all powers will be vested with General Assembly only and bank account will be operated by 3 members with voting rights, duly authorised by the General Assembly.
(iv) An Office Bearer shall be suspended from holding the office immediately upon his conviction by a court of law for any offence.
(v) An Office Bearer of any other National Sports Federation who has completed one term or 3 years, shall not be eligible to contest for the post of an Office Bearer in I.S.AI. without meeting the cooling-off period requirement of four years.
ARTICLE 21
No Confidence Motion
(a) If one-third of the voting members write to the Secretary General or President for No-confidence against any office bearer/s or Executive Council member/s ten days before any meeting of the General Assembly, this will be the first agenda point of the meeting after the opening address of the President, if any.
(b) To pass a resolution of No-confidence, it will be a mandatory requirement that such resolution against the President, and/or any office bearer and other Executive Council Members be passed only by 2/3 members of General Assembly present and voting. A resolution of No-confidence not supported by 2/3 majority will be deemed to have fallen through and the motion will be treated as null and void. The quorum for such meeting will be 2/3 of the total strength of the representatives of the ISAI entitled to vote.
ARTICLE 22
General Disciplinary Regulations
(i) All Associations affiliated to the ISAI shall commit themselves to appeal only to the President of the ISAI in the event of any differences which may arise with regard to the functioning of the Associations within its laid down Statutes and Regulations. However decision of President will be applicable only after getting it approved by the General Assembly.
(ii) If any State/U.T. Association does not hold elections after the completion of the normal tenure for which the office-bearers are elected, it will furnish reasons to the President/Secretary of the ISAI.
(iii) Any extension of the tenure of the office-bearers of any state Association will be subject to obtaining prior written permission from the President and Secretary of the ISAI otherwise voting right of the Association will be suspended till its elections are held.
(iv) While conducting their elections, units will write to the Secretary General or President of ISAI, at least 15 days before, to send an observer of ISAI otherwise elections will be nullified. If ISAI sends an observer, his/her report will be final about the election.
ARTICLE 23
An Athlete Advisory Council [A.A.C]
(i) An Athlete Advisory Council will be formed and following procedure will be adopted:
If M.Y.A.S. issues any guidelines, same will be followed.
(ii) If M.Y.A.S. does not issue any guidelines, then Executive Council will decide Names of Members and send to Ministry of Youth Affairs and Sports, Govt. of India for approval and without its approval Athlete Advisory Council will not be effective.
(iii) Members of the AAC, may not be member of the General Assembly.
ARTICLE 24
A. I.S.A.I.:
(i) The Association will conduct unless exempted for technical reasons, annual National Championships for specified age groups at the Senior, Junior and Sub-Junior levels.
(ii) ISAI will take all necessary steps for the technical development of the sport in India.
(iii) ISAI will endeavor to secure availability of playing field and other amenities to athletes.
(iv) ISAI will make efforts to promote and develop sport all over India for spread of the sport.
(v) ISAI will provide for in house mechanism for redressal of grievances if its members.
I.S.A.I. shall be deemed to be “Public Authority” as defined under the Right to Information Act, 2005.
B. I.S.A.I.
shall every year before the 31st December, publish on its website:
(i) Its audited annual financial statements;
A comprehensive report of its activities and achievements, particularly with reference to aims and objects mentioned in its memorandum of association or articles of association or bye-laws, as the case may be, and obligations enumerated in this section;
(ii) Measures taken for promotion of sports for all, excellence in sports, welfare of athletes, elimination of corruption doping, fraud of age and sexual harassment of women in sports. The calendar for annual national championships in all categories of Sports for which it is registered, on or before the 31st day of December of the preceding year.
C. I.S.A.I.
shall be eligible to receive, direct or indirect, financial assistance and other forms of support and assistance from the Central Government; and International Sports Federations.
Select and nominate the national team which shall represent India in international athletic competition for the sport.
Bid for and host with the prior approval of the Central Government any officially recognised international athletic competition in India subject to the conditions, as may be specified in the approval.
Organize or conduct any officially recognized sport event, including annual national championship for the sport; and
Discharge such other functions and duties as may be required by the International Federation accept donations/sponsorships.
ARTICLE 25
(i) I.S.A.I will make Organisational Chart and mission statement as per government guidelines.
(ii) I.S.A.I. shall follow all guidelines issued by Government from time to time about Review of Previous Year. The review should list the tasks that were proposed for the previous year identifying the extent to which they were completed, stating reasons, shortcomings, if any, and identifying the implications of this for future years.
(iii) I.S.A.I shall constitute committees for development as per M.Y.A.S. guidelines.
ARTICLE 26
(i) I.S.A.I. shall take measures and submit the following reports to the Government:
(ii) Audited annual financial statements;
(iii) A comprehensive report of activities and achievements, particularly with reference to the aims and objects of its constitution and the obligations enumerated as per guidelines of the Government.
(iv) Measures taken to promote athlete’s welfare. Measures taken to fight against corruption, doping, age fraud, sexual harassment of women and child abuse in sports; and
(v) Measures taken to promote sports for all, particularly participation of youth, women, the disabled and minorities in athletic activities; and Measures taken to promote excellence in sport and in the performance of elite Athletes.
ARTICLE 27
(i) I.S.A.I will comply with all the provisions of National Sports Legislation or such other Acts and Rules as and when it will be enacted by Ministry of Sports and Youth Affairs, Govt. of India.
(ii) If any Article is in contradiction with National Sports Act, as and when passed by the Parliament, Govt. of India or amended in future, Article of the National Sports Act will be final and these Rules and Regulations will be changed within one year.
(iii) Government may appoint Government observers for I.S.A.I.
ARTICLE 28
(i) I.S.A.I. will have the headquarter at Delhi which is its place of registration. I.S.A.I. will have paid Asst. Secretary/Director, in its head quarter. The Association will be autonomous and resist all pressures of any kind, whatsoever, whether of a political, religious, racial or economic nature. The Association shall maintain public accountability.
(ii) It shall have an in-house grievance redressal mechanism for redressal of grievances relating to efficient functioning, election of Office Bearers, truly representative character of the general body, protection of interests of athletes, promotion of the sport, maintenance and audit of accounts, moving of no confidence resolutions and connected internal management matters.
ARTICLE 29
A. I.S.A.I shall bound by the following provisions:
(i) Every amendment in the bye-laws of I.S.A.I shall be passed by a Special Resolution and before coming into force it shall have to be informed to the Registrar of Societies.
(ii) All NADA rules notified by the government in official Gazatte will be followed.
(iii) National Code for Prevention of Age fraud in sport issued by the Government time to time. Guidelines for prevention of sexual harassment of women in sports issued by the Government from time to time.
B. Participation of Indian Citizens only
(i) Only Indian citizens holding Indian passport, including Non-Resident Indians, shall be eligible to represent India in National and International sports competitions.
(ii) Persons of Indian Origin and Overseas Citizens of India shall not be treated as Indian citizens for this purpose.
(iii) This restriction shall be applicable to both single-sport and multi-sport events.
ARTICLE 30
A. National Coach
I.S.A.I shall appoint National Coach with the help of S.A.I as per government guidelines.
B. Selection of Athletes
Selection of athletes will be done as per government guidelines.
Article 24,25,26,27,30 will be applicable only after recognition of I.S.A.I. with M.Y.A.S.
ARTICLE 31
1. ISAI shall comply with ISU Anti-Doping Rules and Procedures as per ISU Communication No. 1447 and 1448 and any future ISU communications on the subject.
2. ISAI shall comply with all NADA and Doping Rules and Procedures framed and revised from time to time by Govt. of India, Indian Olympic Association and International Olympic Committee.
ARTICLE 32
General
(i) In all matters which have been specially legislated for, the decision of the General Assembly of the ISAI shall be final and binding. The interpretation of the articles of the Constitution, rules etc by the General Assembly shall be final. Any matter not provided for in these rules shall be dealt with by the General Assembly only.
(ii) Once in every year, a list of the Members of the Executive Council containing their names, addresses and designations shall be filed with the Registrar of Societies as required under Section 4 of the Societies Registration Act 1860 as applicable to Union Territory of Delhi.
(iii) The ISAI may sue or be sued in the name of President and/or Secretary General as required under Section 6 of the Societies Act.
(iv) Any amendments in the Memorandum of the ISAI or its name shall be carried out as per the procedure laid down in Sections 12 and 12 (a) of the Societies Registration Act 1860.
ARTICLE 33
Arbitration Committee
(1) ISAI will make an Arbitration Committee of three members through General Assembly or Executive Council. This committee will be autonomous and impartial and handle athletes grievances as well as other sports related disputes between
(a) I.S.A.I. and its members.
(b) between I.S.A.I. and other stakeholders
(c) among its members and athletes and
(d) among athletes.
(2) Any person will appeal to Arbitration
Committee within 21 days of date of dispute. After 21 days appeal will not be entertained.
(3) Decision of Arbitration Committee will be given with in 30 days of appeal and will be final and applicable to all members.
(4) In case of appeal by an athlete on or off the field, decision will be given within 48 hours of the representation. However, decision about on the field should come through Jury of Appeal, which will be formed for each event by the President and Secretary.
(5) Any person can challenge decision of Arbitration committee in ‘Sports Dispute Settlement and Appellate Tribunal’ (or any other similar body) of M.Y.A.S. or Arbitration Commission of Indian Olympic Association.
(6) Any person can go directly ‘Sports Dispute Settlement and Appellate Tribunal’ (or any other similar body) of M.Y.A.S. or Arbitration Commission of Indian Olympic Association.
(7) Any dispute concerning I.S.A.I. with any sports related body, including management conflicts or disputes shall be referred to the ‘Sports Dispute Settlement and Appellate Tribunal’ (or any other similar body) set up by the Government or to Arbitration Commission of I.O.A.
(8) (i) All awards given by the ‘Sports Dispute Settlement and Appellate Tribunal’ shall be final Awards enforceable under the Arbitration and Conciliation Act, 1996 and shall be binding upon the parties.
(ii) No person of any unit of the ISAI shall go to any court of law; prior to the decision/award of Arbitration committee of I.S.A.I. or ‘Sports Dispute Settlement and Appellate Tribunal’ of M.Y.A.S. or Arbitration Commission of I.O.A. against ISAI for any dispute otherwise he, as an individual, cannot attend any meeting of ISAI with immediate effect till the final decision of the court.
(iii) No unit of the ISAI shall go to any court of law; prior to the decision/award of the Arbitration committee of I.S.A.I. or ‘Sports Dispute Settlement and Appellate Tribunal’ of M.Y.A.S. or Arbitration Commission of I.O.A. against ISAI for any dispute; otherwise no member of that unit can attend any meeting of ISAI and that unit will not have voting right with immediate effect till the final decision of the court.
ARTICLE 34
(i) All disputes will be subject to jurisdiction of Delhi only.
(ii) The ISAI shall be dissolved as per the procedure laid down in the Section 13 of the Societies Act. After dissolution, the assets of the Society after clearing the liabilities, shall be disposed off in accordance with the procedure laid down in Section 14 of the Societies Registration Act 1860.
